Terms of Use

1. Introduction

These Terms of Use govern your use of the Pixelore desktop application and this website. By downloading, installing, or using Pixelore, you agree to be bound by these Terms. If you do not agree, please do not use the software.

2. License

Pixelore is free, open-source software distributed under the MIT License. You may use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, subject to the following conditions:

• The above copyright notice and permission notice shall be included in all copies or substantial portions of the Software.

3. Intellectual Property

The Pixelore name, logo, and branding are the property of Take Control – Software & Infrastructure EOOD. The source code is licensed under MIT, but the trademark and branding may not be used without prior written permission. You may not use our name or branding to imply endorsement of derivative works.

4. Your Photos

You retain all rights to your photographs. Pixelore does not claim any ownership, license, or rights over images you edit with the software. All processing happens locally on your computer. We never access, view, or store your photos.

5. Third-Party Libraries

Pixelore incorporates the following open-source libraries, each under their own license:

• LibRaw (LGPL 2.1 / CDDL 1.0) — RAW image decoding. Dynamically linked.
• OpenCV (Apache 2.0) — Image processing algorithms.
• Little CMS (lcms2) (MIT) — ICC color profile handling.
• libexif (LGPL 2.1) — EXIF metadata read/write. Dynamically linked.
• Flutter (BSD 3-Clause) — UI framework.

LGPL libraries (LibRaw, libexif) are dynamically linked, satisfying LGPL requirements while allowing Pixelore to be distributed under the MIT License.

6. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Take Control – Software & Infrastructure EOOD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the software.

8. Responsible Use

You agree not to:

• Use the software to process or distribute illegal content
• Reverse engineer the software for malicious purposes
• Distribute modified versions under the Pixelore name without permission
• Remove or alter any copyright, trademark, or attribution notices

9. Export Restrictions

You may not access or use the software from any territory where its use would be illegal. You are responsible for compliance with all applicable export laws and regulations.

10. Termination

We reserve the right to modify or discontinue the software at any time without notice. Your license to use the software continues indefinitely under the MIT License terms, even if we discontinue development.

11. Updates to These Terms

We may update these Terms from time to time. Changes will be reflected in the "Last updated" date above. Continued use of the software after changes constitutes acceptance of the updated Terms. We encourage you to periodically review this page.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bulgaria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria.
