These Terms of Use govern your use of the Pixelore desktop application and this website. By downloading, installing, or using Pixelore, you agree to be bound by these Terms. If you do not agree, please do not use the software.
Pixelore is currently distributed as a Beta release. The software is under active development and testing — features, behaviour, performance and user interface may change between versions. Use in production workflows is at your own discretion and risk.

During the Beta period, Pixelore is made available free of charge for personal evaluation and testing. We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the software for this purpose, subject to these Terms.

The source code published in the project repository is provided for transparency and authorised collaboration only and does not grant any of the rights listed above. We reserve the right to introduce paid editions and to change the licensing terms in future releases.
The Pixelore software, source code, name, logo and branding are the exclusive property of Take Control - Software & Infrastructure EOOD. No rights are granted to you except as expressly set out in these Terms.
You retain all rights to your photographs. Pixelore does not claim any ownership, licence or rights over images you edit with the software. All processing happens locally on your computer. We never access, view or store your photos.
Pixelore incorporates the following third-party libraries, each used under its own licence:
LGPL libraries (LibRaw, libexif) are dynamically linked so that their licence obligations are satisfied without affecting the proprietary licence of Pixelore itself.
THE SOFTWARE IS PROVIDED "AS IS" AND ON A "BETA" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN NO EVENT SHALL TAKE CONTROL - SOFTWARE & INFRASTRUCTURE EOOD BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
To the maximum extent permitted by applicable law, Take Control - Software & Infrastructure EOOD shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of data, loss of profits or business interruption, arising from your use of or inability to use the software.

You may not access or use the software from any territory where its use would be illegal. You are responsible for compliance with all applicable export laws and regulations.
We reserve the right to modify, suspend or discontinue the software, the Beta programme, or your licence to use it at any time and without notice. On termination you must stop using and uninstall the software.
We may update these Terms from time to time. Changes will be reflected in the "Last updated" date above. Continued use of the software after changes constitutes acceptance of the updated Terms. We encourage you to periodically review this page.
These Terms shall be governed by and construed in accordance with the laws of Bulgaria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria.
